Welcome to the Trejoï website www.trejoi.com (the “Site”) owned and operated by Trejoi Ltd and its owners. These terms and conditions (“the Terms”) govern your use of the Site. By using this website you acknowledge that you have read the Terms and you are agreeing to comply with and be subject to these Terms. If you do not agree to these Terms, you should not access or use the Site. The purchasers of products from Trejoi Ltd are subject to the following terms and conditions. 

General Information

Information contained on this website is available for your personal, noncommercial use, which is limited to viewing the Site purchasing products and providing information to the Site. Trejoi Ltd reserves the right to change or amend the Site and the Terms at any time without notice. No material from the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. 

Pricing Information

Trejoi Ltd reserves the right, at any time, to change its prices on the Site for products or services sold, effective immediately. Prices displayed on the Site are inclusive of VAT and exclusive of any other taxes which may be applicable. Products may be displayed as out of stock or discontinued, and prices are subject to change. Trejoi Ltd is not responsible for typographical errors with regards to price or any other matter.

Product Information

Although Trejoi Ltd has made every effort to display products and their colors as accurately as possible, the displayed colours of the products depend upon the monitor of the user, and Trejoi Ltd cannot guarantee that the user’s monitor will accurately portray the actual colours of the products. 

Proprietary Rights

The Site contains material which is trademarked and licensed to Trejoi Ltd and which is prohibited from being copied or reproduced in any form. This includes, but is not limited to, our design, logo, illustrations and photographs. Any intellectual property on the Site shall remain the property of Trejoi Ltd. Such property shall not be copied and/or used unless specifically authorised by Trejoi Ltd. This includes the designs of products displayed on and/or sold from this Site.

Delivery and Returns

Reduced shipping rates apply for toys, leashes, collars, harnesses, treats (small packets), clothing in Europe, America, North Africa and other select countries. Shipping for heavy and bulky items is charged according to weight. The shipping costs depend on the shipping address of the Purchaser. The shipping costs are weight based and must be paid upon placement of the order. Customers can choose between tracked or express shipping. No goods shall be returned for credit or replacement without prior contact to Trejoï through email or the contact form. 

Terms of Payment

Payment is due upon placement of order. Payment method will be by card. Seller may pursue any legal or equitable remedies, in which event the Seller shall be entitled to reimbursement for costs of collection and reasonable attorney fees in the case of non-payment. There shall be no time limit as to when Seller shall pursue any legal or equitable remedies.

The Site uses Secure Sockets Layer (SSL) to ensure security, privacy and to protect user transactions.

Privacy Policy

Notwithstanding anything else to the contrary contained in these Terms of Use, Trejoi Ltd’s use of any Personally Identifiable Information you disclose through the Site shall be governed by our Privacy Policy. Please refer to our Privacy Policy page for further information regarding Trejoi Ltd’s protection of your personal information.

Disclaimers and Limitation of Liability

Trejoi Ltd shall in no event be liable for any direct, indirect, punitive, incidental, special, or consequential damages whatsoever, for injury to any property or to any person, arising out of or connected with the use or misuse of any pet product purchased herein. The Purchaser shall agree and acknowledge that any product purchased should be used at their own risk and the Purchaser should assess the risks individual to their pet before purchasing any product or using any product with or on their pet. The Purchaser agrees that in the event that Trejoi Ltd is deemed liable for any harm caused, the amount which is liable to the Purchases shall be limited to the cost of the product. In no event should you allow your pet to use this product unattended, nor should you leave any children unattended in the presence of this product as it may present a choking hazard.

Indemnity

You agree to defend, indemnify and hold Trejoi Ltd,  its directors, subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any and all loss, liabilities, damages, claims, demand, costs and expenses, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Site, your violation of the Terms or the posting or transmission of any materials on or through the Site by you, including but not limited to any third-party claim that any information or materials you provide infringes any third-party proprietary right.

General Information

These Terms constitute the entire agreement between you and Trejoï and govern your use of the Site, and they supersede any prior agreements between you and Trejoi Ltd. Trejoi Ltd may terminate this Agreement and deny you access to the Site at any time, immediately and without notice, if in Trejoi Ltd’s sole discretion you fail to comply with any provision of these Terms. 

These Terms and other policies on this Site shall be governed by, construed and enforced in accordance with the Laws of Malta, Europe, without giving effect to any conflict of law provisions. 

Any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or invalidity thereof, shall have a first recourse by arbitration in accordance with the rules of the Malta Arbitration Centre as in force on the date on which such dispute, controversy or claim arises.
